Terms of Service
Last updated . By downloading or using FirstSpar you agree to these terms. If you do not agree, please do not use the app.
The short version. FirstSpar is rehearsal software. It is not therapy, HR advice, or legal advice, and the counterpart you speak to is a simulation, not a person. Subscribe if it helps; cancel any time in your App Store settings. Do not use it to prepare something you intend to use to harm someone.
Who these terms are with
FirstSpar is provided by Phileo Solutions ("we", "us"). "You" means the person using the app.
What FirstSpar is
FirstSpar lets you rehearse a difficult workplace conversation out loud against an AI counterpart, and gives you a scored debrief afterwards. It is a practice tool. That is the whole of what it claims to be.
What FirstSpar is not
This matters more than most sections of a document like this.
- It is not therapy or mental health care, and it is not a substitute for either.
- It is not legal, HR, or employment advice. Nothing it says should be relied on as a professional opinion about your situation, your rights, or anyone else's.
- It is not a reporting channel. Telling FirstSpar about harassment, discrimination, or misconduct does not report it to anyone. Nobody is notified and no action is taken.
- It is not for emergencies. If you or someone else is at risk, contact your local emergency services.
- The counterpart is not a real person and does not represent the real colleague you are preparing to speak to. How it behaves is not evidence of how they will.
The app is built to notice when a rehearsal has stopped being one. If you disclose something that sounds like genuine distress, it will stop the exercise and point you to real support rather than carry on playing a part. That is a safety feature, not a judgement, and it is not a substitute for talking to someone.
About the AI
The counterpart's speech and your debrief are generated by a large language model. Generated content can be wrong, inconsistent, or unhelpful. Scores are an opinion produced by software, not a measurement, and they are not an assessment of you as a manager or as a person. Use your own judgement about the real conversation.
We deliberately do not generate scripts. The debrief will not write your lines for you — it comments on your approach. That is a design constraint, not a limitation we intend to remove.
Your account
The app creates an anonymous account for you automatically so your history has somewhere to live. You may optionally attach an Apple or Google identity so that history survives a new device. You are responsible for keeping access to whatever identity you attach.
You may delete your account at any time from Settings. Doing so removes your data immediately and cannot be undone.
Acceptable use
You agree not to:
- use FirstSpar to prepare, rehearse, or refine harassment, threats, discrimination, or any conduct intended to harm another person;
- impersonate someone in order to obtain a simulation about them for a purpose other than your own preparation;
- attempt to extract, reverse-engineer, or resell the underlying models, prompts, or generated content as a service;
- interfere with the app's security, circumvent the usage limits, or access another person's data;
- use the app in breach of any law that applies to you.
We may suspend or end access where these terms are broken. Where it is reasonable to do so, we will say why.
Your content
What you tell the app about your situation, and what you say during a spar, remains yours. You grant us only the permission needed to run the service: to send it to our AI provider so a response can be generated, and to store it in your account so your debrief and logbook work. We do not use it to train models and we do not publish it. See the Privacy Policy for detail.
Please be thoughtful about naming real colleagues. The app needs enough detail to build a believable counterpart, and generally that is the behaviour rather than the identity.
Subscriptions
FirstSpar has a free tier that lets you build your own conversation and spar it three times a week, with the full debrief and nothing held back. FirstSpar Pro unlocks the written scenario library, the higher levels of pushback, the choice of session length, and practising as often as you need to.
Pro is offered as a weekly or an annual subscription. Prices are shown in the app in your local currency before you buy, and may vary by region. Any free trial is stated at the point of purchase; the annual plan includes one and the weekly plan does not.
Purchases are processed by Apple through your App Store account, not by us. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends. Your account is charged for renewal within 24 hours of the end of the current period.
Cancelling
Manage or cancel your subscription in your App Store account settings — iOS Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for. Deleting the app does not cancel a subscription.
Refunds
Because Apple takes the payment, Apple handles refunds. Request one through reportaproblem.apple.com. We cannot issue refunds directly, but if something went wrong on our side, tell us — we would rather know, and we will support a refund request where it is warranted.
If you are a consumer in the UK or the EU, your statutory cancellation rights are unaffected by anything in this section.
Changes to the app and these terms
FirstSpar is under active development and features may change or be removed. If we change these terms materially, we will update this page and the date at the top, and surface the change in the app. Continuing to use FirstSpar after that means you accept the updated terms.
Warranties and liability
FirstSpar is provided "as is". We do not warrant that it will be uninterrupted, error-free, or that any particular outcome will follow from using it. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for any decision you take at work on the basis of a rehearsal or a score.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you have legal rights that these terms do not affect.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country's law.
